Terms of Service

1. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract to use Boreo. By creating an account, you confirm you meet these requirements.

2. Account registration

To use Boreo, you must create an account with a valid email address. You are responsible for:

• Providing accurate registration information
• Maintaining the security of your account credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorized access through our contact form at boreo.app/support

You may not share your account, transfer it, or allow others to use it.

3. Subscription plans and billing

Boreo offers subscription plans with different feature access and included video allocations. Current plans and pricing are shown at boreo.app/pricing.

Billing terms

• Subscriptions are billed monthly or annually in advance
• All prices are in US dollars (USD)
• All prices are exclusive of VAT and any other applicable sales taxes
• VAT is determined by your billing country and added on top of the displayed price at checkout
• Payments are processed via Stripe
• Subscriptions renew automatically until cancelled
• You may cancel your subscription at any time from your account settings
• Cancellation takes effect at the end of the current billing period

Included videos and credits

• Each subscription tier includes a monthly video allocation
• Unused videos do not roll over between billing periods
• Extra credits purchased separately do not expire
• Premium features (advanced animation, 4K images) consume credits from your allocation

4. Refunds

We do not offer refunds once videos have been generated or credits have been consumed. This is because AI generation and rendering consume real infrastructure costs at the moment of use.

Exceptions

• If a video generation fails due to a technical issue on our side, the credits are automatically refunded
• If you cancel your subscription, you retain access through the end of your current billing period
• We may offer discretionary refunds in exceptional circumstances at our sole judgment

5. Content ownership

You own the videos you generate. You retain 100% ownership of any video content, thumbnails, scripts, and other creative outputs Boreo produces for you. You may:

• Publish generated content on any platform
• Monetize generated content commercially
• License, modify, or resell generated content
• Use generated content without attribution to Boreo

Boreo does not train AI models on your content or your generated outputs. Your reference videos, scripts, and generated videos remain your property and are not used to train underlying models.

6. Learning system

Boreo includes a learning system that improves recommendations based on your channel's performance. This system uses aggregated, anonymized signals — such as which titles or thumbnail styles correlate with viral videos in your niche — to improve future recommendations.

The learning system does NOT

• Train AI models on your specific content
• Share your channel performance data with other users
• Reveal individual user data to third parties

The learning system DOES

• Aggregate patterns from viral references you provide
• Track performance of videos you publish through Boreo to inform your own future recommendations
• Improve overall system intelligence through anonymized aggregate patterns

7. Acceptable use

You may not use Boreo to create, distribute, or facilitate content that:

• Contains child sexual abuse material (CSAM) or exploits minors
• Depicts non-consensual intimate imagery or "deepfake" imagery of real individuals without documented consent
• Impersonates real individuals in a manner intended to deceive or harm
• Constitutes political disinformation, election interference, or fraudulent political messaging
• Infringes intellectual property rights, including copyrighted characters, brands, or protected content
• Promotes violence, terrorism, hate speech, or discrimination based on protected characteristics
• Contains illegal content or facilitates illegal activity
• Violates YouTube Community Guidelines or the terms of any platform where content is published
• Constitutes spam, scam, or fraudulent solicitation
• Contains malware, phishing, or other technically harmful content

8. Third-party services

Boreo integrates with third-party services including Stripe for payment processing.

Your use of these third-party services through Boreo is subject to their respective terms of service. Boreo is not responsible for the availability, accuracy, or performance of third-party services.

9. Intellectual property

Boreo's IP: The Boreo platform, including software, design, branding, and documentation, is owned by Boreo and protected by intellectual property laws. You may not copy, modify, distribute, sell, or reverse-engineer Boreo's platform.

Your license to Boreo: You grant Boreo a limited, non-exclusive, revocable license to process your reference materials, scripts, and generated content solely to provide the service to you.

10. Data protection

Your use of Boreo is subject to our Privacy Policy, which describes how we collect, use, and protect your personal data in compliance with the EU General Data Protection Regulation (GDPR) and applicable Dutch law.

11. Service availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may:

• Perform scheduled maintenance with advance notice
• Modify or discontinue features with reasonable notice
• Suspend service in response to security threats or legal requirements

We are not liable for service interruptions caused by third-party providers, force majeure, or circumstances beyond our reasonable control.

12. Limitation of liability

To the maximum extent permitted by law:

• Boreo is provided "as is" without warranties of any kind
• We are not liable for indirect, incidental, consequential, or punitive damages
• Our total liability to you for any claim is limited to the amount you paid us in the twelve months preceding the claim
• Nothing in these Terms excludes liability that cannot be excluded under applicable law, including consumer protection rights

13. Termination

By you: You may terminate your account at any time through account settings.

By us: We may suspend or terminate your account for:

• Violation of these Terms or our Acceptable Use Policy
• Non-payment of fees
• Fraudulent or abusive behavior
• Legal or regulatory requirements

Upon termination

• Access to your account and generated content ends
• We retain your data for 90 days per our Privacy Policy, after which it is permanently deleted
• You remain liable for any outstanding fees

14. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified to you via email at least 30 days before taking effect. Continued use of Boreo after changes take effect constitutes acceptance.

15. Governing law and disputes

These Terms are governed by the laws of the Netherlands. Any disputes shall be resolved by the competent courts of Amsterdam, the Netherlands.
